On June 1, 2026, the Office of the U.S. Trade Representative (USTR) issued its determination in the Section 301 investigation of Brazil. USTR found that certain of Brazil's acts, policies, and practices are unreasonable, burden or restrict U.S. commerce, and are therefore actionable under Section 301(b) of the Trade Act of 1974. The targeted practices relate to digital trade and electronic payment services; unfair preferential tariffs; anti-corruption enforcement; intellectual property protection; ethanol market access; and illegal deforestation.
Proposed action. USTR proposes to impose additional tariffs of 25% on all goods of Brazil, with exemptions for certain goods. The exemptions include informational materials; donations; accompanied baggage; all articles and parts of articles subject to Section 232 tariffs; and certain products identified in the Annex to the notice. The Annex covers, among other things, raw materials; products that could cause economy-wide disruptions; and products not available in sufficient quantities from the United States or other sources.
Comment period and hearing. The comment period opened June 1, 2026. Key deadlines follow:
June 22, 2026 — Requests to appear at the hearing, with a summary of testimony, due (docket USTR-2026-0397).
